AN ACT

MAKING A CONTINUING APPROPRIATION FROM THE TOBACCO SETTLEMENT PERMANENT FUND TO THE CHILDREN, YOUTH AND FAMILIES DEPARTMENT FOR THE PURPOSE OF SUPPORTING YOUTH DEVELOPMENT AND PREVENTION PROGRAMS OF BOYS' AND GIRLS' CLUBS THROUGHOUT NEW MEXICO.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. CONTINUING APPROPRIATION.--In fiscal year 2001 and each year thereafter, one million five hundred thousand dollars ($1,500,000) is appropriated from the tobacco settlement permanent fund to the children, youth and families department to support boys' and girls' clubs smart moves youth development and prevention programs throughout the state. Any unexpended or unencumbered balance remaining at the end of each fiscal year shall revert to the tobacco settlement permanent fund. The department shall, by rule, develop an application process for boys' and girls' clubs and procedures for reviewing the applications and distributing the appropriation. In developing the process and procedures, the department shall ensure that the appropriation is expended on programs that:

A. improve the motivation, performance and self-esteem of youths;

B. can be expected to reduce tobacco use, school dropout and teen pregnancy rates;

C. develop an environment in New Mexico that promotes healthy lifestyles among youths;

D. discourage the initiation of tobacco use; or

E. increase the resources and assistance available to boys' and girls' clubs and communities to become tobacco free.
