MAKING APPROPRIATIONS FOR SALARY INCREASES FOR EXECUTIVE, JUDICIAL AND LEGISLATIVE EMPLOYEES AND ELECTED OFFICIALS; PUBLIC SCHOOL TEACHERS AND OTHER PERSONNEL; AND FACULTY AND STAFF OF INSTITUTIONS OF HIGHER EDUCATION.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATIONS.--

A. Sixteen million one hundred fifty-four thousand one hundred dollars ($16,154,100) is appropriated from the general fund to the department of finance and administration for expenditure in fiscal year 2001 to provide salary increases as follows:

(1) ten million dollars eight hundred twenty thousand seven hundred dollars ($10,820,700) to provide a three percent salary structure adjustment on July 1, 2000 and to provide eligible classified employees in agencies governed by the Personnel Act with a variable pay anniversary date salary increase based on the employee's performance evaluation rating and compa-ratio in accordance with a salary matrix approved by the personnel board developed from a total funding level for providing an average of approximately one and one-half percent anniversary date merit increase, including lump-sum payments. This increase includes providing annualized variable pay anniversary date lump-sum payments to eligible classified employees whose salaries equal or exceed their salary grade maximums. The salary increases shall be effective the first full pay period following the employee's anniversary date;

(2) one million two hundred thirty-nine thousand three hundred dollars ($1,239,300) to provide executive exempt employees, including attorney general employees, workers' compensation judges and exempt teachers in the corrections and children, youth and families departments and the department of health, with merit salary increases equal to four and one-half percent, effective on the first full pay period following the employee's anniversary date;

(3) three hundred fifty-nine thousand nine hundred dollars ($359,900) to provide New Mexico state police commissioned officers with a step increase on the first full pay period following the officer's anniversary date in accordance with the career pay system of the New Mexico state police;

(4) three hundred thirty-three thousand dollars ($333,000) to provide permanent employees of the legislative branch with an average four and one-half percent merit pay increase, effective the first full pay period after the employee's anniversary date;

(5) six hundred eighty-nine thousand four hundred dollars ($689,400) to provide justices of the supreme court; judges of the court of appeals, district courts, metropolitan court and magistrate courts; child support hearing officers; special commissioners; and district attorneys with a salary increase of four and one-half percent effective the first full pay period after July 1, 2000;

(6) one million six hundred nineteen thousand dollars ($1,619,000) to provide all judicial permanent employees, including employees of the judicial standards commission, and excluding employees whose salaries are set by statute, with a three percent salary adjustment on July 1, 2000 plus an average anniversary date salary increase equivalent to one and one-half percent of the midpoint value of an employee's salary range, effective the first full pay period following the employee's anniversary date and subject to satisfactory job performance and in accordance with the judicial personnel and compensation plan; and

(7) one million ninety-two thousand eight hundred dollars ($1,092,800) to provide all district attorney permanent employees, other than district attorneys, with a three percent salary adjustment on July 1, 2000 plus an average anniversary date salary increase equivalent to one and one-half percent, effective the first full pay period following the employee's anniversary date and subject to satisfactory job performance and in accordance with the district attorney personnel and compensation plan.

B. Fifty-seven million seven hundred eight-six thousand nine hundred dollars ($57,786,900) is appropriated from the general fund to the state department of public education for expenditure in fiscal year 2001 to provide salary increases for public schools as follows:

(1) thirty-eight million three hundred eighty-four thousand five hundred dollars ($38,384,500) to provide teachers with a five percent salary increase; and

(2) nineteen million four hundred two thousand four hundred dollars ($19,402,400) to provide other certified and noncertified staff, including transportation employees, with a four percent salary increase.

C. Twenty-one million seven hundred fifty thousand eight hundred dollars ($21,750,800) is appropriated from the general fund to the commission on higher education for expenditure in fiscal year 2001 to provide salary increases for post-secondary educational institutions as follows:

(1) fourteen million forty-eight thousand dollars ($14,048,000) to provide faculty of four-year and two-year educational institutions with a five percent salary increase; and

(2) seven million seven hundred two thousand eight hundred dollars ($7,702,800) for other staff of four-year and two-year educational institutions with a four percent salary increase.

D. For those state employees whose salaries are referenced in or received as a result of non-general fund appropriations in the General Appropriation Act of 2000, the department of finance and administration shall transfer from the appropriate fund to the appropriate agency the amount required for the salary increase equivalent to the increases provided for in this act, and such amounts are appropriated for expenditure in fiscal year 2001.

E. Any unexpended or unencumbered balance remaining at the end of fiscal year 2001 from the appropriations made in this act shall revert to the fund from which the appropriation was made.
