RE: Summary of Public School-Related Legislation Passed by the Forty-Fifth Legislature, Second Session, 2002 (After Executive Action)
Enclosed for your information are updates to the February 20, 2002 memorandum summarizing public school-related legislation passed by the 2002 Legislature. These materials reflect final action by the Governor.
The 2002 Legislature passed two versions of the General Appropriation Act of 2002 that provided FY 03 public school funding, but Governor Johnson vetoed both (refer to Tables 1 and 2). On February 7, 2002, the Governor vetoed CS/HB 2, et al., stating that the bill did not provide for a flat budget, adequate reserves for our future, or responsible Medicaid spending. On March 6, 2002, he vetoed CS/SB 1. In his veto message, the Governor reiterated the concerns he had expressed earlier. In his partial veto message of *CS/H 88, as amended, Governor Johnson concluded, AChoices have been made. Laws have been signed or vetoed. The 45th Legislature is officially over pursuant to the Constitution. I will now take all necessary and appropriate executive action to manage the government over the remainder of my term in office."

STATE DEPARTMENT OF PUBLIC EDUCATION:
The general fund appropriation to the state department of public education in the personal services and employee benefits category includes sufficient funds for two permanent FTE for the agriculture program located in Las Cruces.
The state board of education is directed to evaluate funds appropriated to New Mexico under the 2001 reauthorization of the federal Elementary and Secondary Education Act, ANo Child Left Behind@, to determine how the federal initiatives align with legislative initiatives and identify how those federal funds can be used in conjunction with state funds to enhance state appropriations for the state department of education and public school support. The state board of education shall report to the legislative finance committee and the legislative education study committee by May 1, 2002.
Unexpended or unencumbered balances in the state department of public education remaining at the end of fiscal year 2003 from appropriations made from the general fund shall revert.

Except as otherwise provided, balances of appropriations made in this subsection shall not revert at the end of fiscal year 2003.
The general fund appropriation for the state equalization guarantee distribution contains sufficient funds to offset the estimated increases in medical insurance premiums incurred in fiscal year 2003 by public school employees, including public school transportation employees.

The rate of distribution of the state equalization guarantee distribution shall be based on a program unit value determined by the superintendent of public instruction. The superintendent of public instruction shall establish a preliminary unit value to establish budgets for the 2002-2003 school year; and then upon verification of the number of units statewide for fiscal year 2003 but no later than January 31, the superintendent of public instruction may adjust the program unit value.
For the 2002-2003 school year, the state equalization guarantee contains sufficient funding for districts implementing a formula-based program for the first time. Those districts shall use current year MEM in the calculation of program units for the new formula-based program.

*H 18 SCHOOL DISTRICT BOND ANTICIPATION NOTES ACT, SGND (Mar. 4) Ch. 54, Burpo — creates the School District Bond Anticipation Notes Act; provides a mechanism for school districts to obtain short-term financing for capital projects that are needed to meet the educational needs of students in school districts; and provides an alternative method to obtain funding for capital projects by school districts.
CS/H 28a INDIAN EDUCATION ACT, VETO (Mar. 5), Begaye — creates the Indian Education Act and the Indian and Higher Education Fund to ensure equitable educational opportunities for American Indian students enrolled in New Mexico public schools; creates a new Indian Education Division at SDE and an advisory council to provide assistance to school districts and tribes; sets out duties for the Indian Education Division; appropriates $400,000 from SDE cash balances and $250,000 from the General Fund to the Indian and Higher Education Fund for FY 03 and FY 04 to carry out the provisions of the Indian Education Act; and repeals the existing Indian Education Division in the Public School Code.
