AN ACT

RELATING TO ELECTIONS; PROHIBITING THE SECRETARY OF STATE OR A COUNTY CLERK FROM SENDING NOTIFICATIONS OF ELIGIBILITY OR POTENTIAL ELIGIBILITY TO REGISTER TO VOTE IN THIS STATE TO PERSONS WHO ARE NOT CITIZENS OF THE UNITED STATES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Election Code is enacted to read:

     "[NEW MATERIAL] NOTIFICATIONS OF REGISTRATION ELIGIBILITY--PROHIBITED ACT.--The secretary of state or a county clerk shall not send a notification of eligibility or potential eligibility to register to vote in this state to:

          A. a person who is not a citizen of the United States; or

          B. a group of persons that includes a person who is not a citizen of the United States."

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2025.
