AN ACT

RELATING TO LOCAL GOVERNMENT FINANCE; CREATING THE LOCAL GOVERNMENT BORDER SUPPORT REIMBURSEMENT FUND; REQUIRING THE DEPARTMENT OF FINANCE AND ADMINISTRATION TO ADMINISTER THE FUND; PROVIDING FOR THE REIMBURSEMENT OF CERTAIN BORDER-RELATED EXPENSES TO LOCAL GOVERNMENTS; REQUIRING RULEMAKING; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] LOCAL GOVERNMENT BORDER SUPPORT REIMBURSEMENT FUND--CREATED--PURPOSE--RULEMAKING.--

          A. As used in this section, "fund" means the local government border support reimbursement fund.

          B. The "local government border support reimbursement fund" is created as a nonreverting fund in the state treasury. The fund consists of appropriations, gifts, grants, donations and income from the investment of the fund. The department of finance and administration shall administer the fund, and money in the fund is appropriated to the department of finance and administration to carry out the provisions of this section. Disbursements from the fund shall be made by warrant of the secretary of finance and administration pursuant to vouchers signed by the secretary of finance and administration or the secretary's authorized representative.

          C. The department of finance and administration shall promulgate rules to administer the fund. Money in the fund shall be used to provide reimbursement to local governments for the following border-related expenses incurred as a direct result of requests from the state and federal government:

                (1) emergency medical services provided to individuals in medical crisis;

                (2) law enforcement response to unattended deaths; and

                (3) costs associated with:

                     (a) specialized equipment necessary to support border patrol, including all-terrain vehicles and trailers;

                     (b) supporting humanitarian efforts, including the provision of transportation, housing, health care and other community services;

                     (c) illegal dumping;

                     (d) state and federal drug trafficking task forces; and

                     (e) state and federal human trafficking task forces."
