AN ACT

RELATING TO POLITICAL SUBDIVISIONS; PROHIBITING PARKING MANDATES; CREATING AN EXCEPTION FOR ACCESSIBLE PARKING.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] MINIMUM PARKING MANDATES PROHIBITED.--

          A. As used in this section, "minimum parking mandate" means a law, rule or ordinance that specifies a minimum number of off-street vehicle parking spaces, including within a garage or other enclosed area.

          B. A political subdivision shall not impose minimum parking mandates for residential, commercial or industrial properties within its jurisdiction.

          C. Nothing in this section prevents a political subdivision from passing a minimum parking mandate related to accessible parking spaces.
