AN ACT

RELATING TO THE LEGISLATURE; REQUIRING THE SECRETARY OF STATE TO PROVIDE NOTICE OF A LEGISLATIVE VACANCY TO THE COUNTY COMMISSIONERS OF ALL COUNTIES IN THE DISTRICT OF THE VACANT LEGISLATIVE OFFICE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 2-1-1 NMSA 1978 (being Laws 1919, Chapter 22, Section 1) is amended to read:

     "2-1-1. RESIGNATION OF MEMBERS--NOTICE OF VACANCIES.--

          A. Any member of the legislature [of the State of New Mexico] may resign [his] the member's office by filing a written statement of [such] resignation with the secretary of state [of New Mexico], and upon the filing of [such] the resignation, the office of senator or representative filled by the person [so] resigning shall become vacant.

          B. Within fifteen days of receipt of a notice of a vacancy of a legislative office, the secretary of state shall provide written notice to the county commissioners of all counties in the district of the vacant legislative office."
