AN ACT

MAKING APPROPRIATIONS FOR PUBLIC HEALTH AND SAFETY INITIATIVES; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. APPROPRIATION--ADMINISTRATIVE OFFICE OF THE COURTS--REGIONAL PLANNING--STATEWIDE RESOURCE MAPPING--JUDICIAL DISTRICT GRANTS--CERTAIN COURTS AND ASSOCIATED PROGRAMS AND SERVICES.--One million seven hundred thousand dollars ($1,700,000) is appropriated from the general fund to the administrative office of the courts for expenditure in fiscal years 2025 through 2029 for regional planning and sequential intercept mapping statewide, including costs associated with monitoring, quality assurance and setting statewide standards related to relevant elements within regional plans. Any unexpended or unencumbered balance remaining at the end of fiscal year 2029 shall revert to the behavioral health trust fund.

     SECTION 2. APPROPRIATION--ADMINISTRATIVE OFFICE OF THE COURTS--JUDICIAL DISTRICT GRANTS--REGIONAL PLANNING, INCLUDING REGIONAL CASE MANAGEMENT.--

          A. Seven million dollars ($7,000,000) is appropriated from the general fund to the administrative office of the courts for expenditure in fiscal years 2025 through 2029 for:

                (1) funding to judicial districts or criminal justice coordinating councils based on the submitted regional plans to enhance regional case management, behavioral health grant writing, peer-operated crisis response and recovery support services, behavioral health, homeless outreach and engagement and family support services; and

                (2) funding to judicial districts based on the submitted regional plans, sequential intercept mapping identified gaps or identified need of the local judicial district for specialty, diversion, problem-solving and treatment courts and associated programs and pretrial services. The administrative office of the courts shall develop program models, standards, guidelines and program evaluation requirements for implementing, enhancing and expanding court-related programs.

          B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2029 shall revert to the behavioral health trust fund.

     SECTION 3. APPROPRIATION--HEALTH CARE AUTHORITY--REGIONAL PLANNING, INCLUDING OUTPATIENT TREATMENT.--Ten million dollars ($10,000,000) is appropriated from the general fund to the health care authority for expenditure in fiscal years 2026 through 2029 for grants to counties and municipalities and Indian nations, tribes and pueblos based on the submitted regional plans for assisted outpatient treatment, medication-assisted treatment, assertive community treatment, other best-practice and evidence-informed outpatient and diversion services, promising practices and community-based wraparound services and resources. Any unexpended or unencumbered balance remaining at the end of fiscal year 2029 shall revert to the behavioral health trust fund.

     SECTION 4. APPROPRIATION--HEALTH CARE AUTHORITY--REGIONAL PLANNING--TRANSITIONAL BEHAVIORAL HEALTH FACILITIES.--Forty-three million dollars ($43,000,000) is appropriated from the general fund to the health care authority for expenditure in fiscal years 2026 through 2029 for grants to counties, municipalities and behavioral health care providers based on the submitted regional plans for regional transitional behavioral health facilities and certified community behavioral health clinics that are located in a municipality with a state institution of higher education and remain eligible for medicaid. The health care authority shall consult with the department of health when making grants to counties and municipalities. Funding may be used to cover service, transportation and lease costs, including community-based services and supports. Not more than eight million dollars ($8,000,000) may be used to establish or expand behavioral health investment zones based on epidemiological data and other source data that identify the combined incidence of mortality related to alcohol use, drug overdose and suicide and on any other behavioral health data deemed necessary. Any unexpended or unencumbered balance remaining at the end of fiscal year 2029 shall revert to the behavioral health trust fund.

     SECTION 5. APPROPRIATION--HEALTH CARE AUTHORITY--REGIONAL PLANNING--CRISIS RESPONSE FACILITIES.--Seven million five hundred thousand dollars ($7,500,000) is appropriated from the general fund to the health care authority for expenditure in fiscal years 2026 through 2029 for use by the authority and for grants to federally qualified health centers, counties and municipalities, Indian nations, tribes and pueblos and behavioral health care providers based on the submitted regional plans for twenty-four-hour crisis response facilities, associated services and technical assistance support. Funding may be used to cover service, logistic and lease costs not eligible for medicaid funding on a multiyear basis. Any unexpended or unencumbered balance remaining at the end of fiscal year 2029 shall revert to the behavioral health trust fund.

     SECTION 6. APPROPRIATION--CORRECTIONS DEPARTMENT--REGIONAL PLANNING--SUPPORT FOR DISCHARGED PERSONS.--One million three hundred thousand dollars ($1,300,000) is appropriated from the general fund to the corrections department, in consultation with the health care authority, for expenditure in fiscal years 2026 through 2029 for use by the department and for grants to counties based on regional plans for discharge planning from correctional facilities and detention centers, and to assist discharged persons to connect with recovery support services and treatment and community-based behavioral health supports that supplement or enhance transitional services covered by medicaid. The corrections department shall consult with the department of health when making grants to counties. Any unexpended or unencumbered balance remaining at the end of fiscal year 2029 shall revert to the behavioral health trust fund.

     SECTION 7. APPROPRIATION--DEPARTMENT OF PUBLIC SAFETY--HEALTH CARE AUTHORITY--REGIONAL PLANNING--CRISIS RESPONSE AND RECOVERY.--

          A. Two million five hundred thousand dollars ($2,500,000) is appropriated from the general fund to the department of public safety for expenditure in fiscal years 2026 through 2029 to be used by law enforcement and behavioral health service providers to purchase regional mobile crisis response, recovery and outreach equipment and vehicles. Any unexpended or unencumbered balance remaining at the end of fiscal year 2029 shall revert to the behavioral health trust fund.

          B. Two million five hundred thousand dollars ($2,500,000) is appropriated from the general fund to the health care authority for expenditure in fiscal years 2026 through 2029 for grants to counties, municipalities and Indian nations, tribes and pueblos based on the submitted regional plans to be used by law enforcement and behavioral health service providers to purchase regional mobile crisis response, recovery and outreach equipment and vehicles. Any unexpended or unencumbered balance remaining at the end of fiscal year 2029 shall revert to the behavioral health trust fund.

     SECTION 8. APPROPRIATIONS--HEALTH CARE AUTHORITY--REGIONAL PLANNING--CRISIS RESPONSE AND RECOVERY TEAMS.--Eleven million five hundred thousand dollars ($11,500,000) is appropriated from the general fund to the health care authority, in consultation with the department of public safety, for expenditure in fiscal years 2026 through 2029 for grants to counties, municipalities and Indian nations, tribes and pueblos based on the submitted regional plans for regional mobile crisis and recovery response, intervention and outreach teams and to support existing co-response models to transition to federally recognized mobile crisis team models to obtain medicaid reimbursement. Funding may also be used to support community-based mobile crisis teams and co-response coordination. Not more than five million five hundred thousand dollars ($5,500,000) may be used by state agencies for regional mobile crisis and recovery response, intervention and outreach teams. Any unexpended or unencumbered balance remaining at the end of fiscal year 2029 shall revert to the behavioral health trust fund.

     SECTION 9. APPROPRIATION--HEALTH CARE AUTHORITY-- EDUCATION AND OUTREACH.--One million dollars ($1,000,000) is appropriated from the general fund to the health care authority for expenditure in fiscal years 2026 through 2029 for education and outreach within behavioral health regions on available behavioral health services based on behavioral health plans. Any unexpended or unencumbered balance remaining at the end of fiscal year 2029 shall revert to the behavioral health trust fund.

     SECTION 10. APPROPRIATION--HEALTH CARE AUTHORITY--REGIONAL PLANNING--CRISIS INTERVENTION AND RESPONSE.--Two million dollars ($2,000,000) is appropriated from the general fund to the health care authority, in consultation with the department of public safety, for expenditure in fiscal years 2026 through 2029 for grants to state agencies, counties and municipalities and Indian nations, tribes and pueblos based on the submitted regional plans for diversion, crisis intervention, collaborative and embedded crisis response, mental health, social work, provider technical assistance and community and intercept resources training. Any unexpended or unencumbered balance remaining at the end of fiscal year 2029 shall revert to the behavioral health trust fund.

     SECTION 11. APPROPRIATION--UNIVERSITY OF NEW MEXICO--HEALTH OUTREACH TO HOMELESS PERSONS.--One million dollars ($1,000,000) is appropriated from the general fund to the board of regents of the university of New Mexico for expenditure in fiscal years 2026 through 2029 for use by the university of New Mexico health sciences center for mobile health units, medication-assisted treatment and other health outreach to homeless persons, including telemedicine. Any unexpended or unencumbered balance remaining at the end of fiscal year 2029 shall revert to the behavioral health trust fund.

     SECTION 12. APPROPRIATION--DEPARTMENT OF HEALTH--HEALTH OUTREACH TO HOMELESS PERSONS.--One million dollars ($1,000,000) is appropriated from the general fund to the department of health for expenditure in fiscal years 2026 through 2029 for mobile health units, medication-assisted treatment and other health outreach to homeless persons, including telemedicine. Any unexpended or unencumbered balance remaining at the end of fiscal year 2029 shall revert to the behavioral health trust fund.

     SECTION 13. APPROPRIATION--DEPARTMENT OF FINANCE AND ADMINISTRATION--REGIONAL PLANNING--EXPANSION OF CERTAIN HOUSING SERVICES.--Forty-eight million dollars ($48,000,000) is appropriated from the general fund to the department of finance and administration for the New Mexico mortgage finance authority as the state housing authority for expenditure in fiscal years 2026 through 2029 to establish a program to support the expansion of housing services providers that facilitate behavioral health services and substance misuse recovery, homelessness assistance and prevention for persons with behavioral health needs and transitional housing. Any unexpended or unencumbered balance remaining at the end of fiscal year 2029 shall revert to the behavioral health trust fund.

     SECTION 14. APPROPRIATION--HEALTH CARE AUTHORITY--988 AND 911 COORDINATION.--Three million dollars ($3,000,000) is appropriated from the general fund to the health care authority for expenditure in fiscal years 2026 and 2027 to enable 988 and 911 coordination as provided in the Behavioral Health Reform and Investment Act. Any unexpended or unencumbered balance remaining at the end of fiscal year 2027 shall revert to the behavioral health trust fund.

     SECTION 15. APPROPRIATION--HEALTH CARE AUTHORITY-- BEHAVIORAL HEALTH PATIENT NAVIGATION.--Nine million dollars ($9,000,000) is appropriated from the general fund to the health care authority for expenditure in fiscal years 2026 and 2027 to expand patient navigation to behavioral health services through a no-wrong-door approach through updates to the YES-NM customer portal and the find help closed-loop referral system to facilitate direct and immediate connections to available behavioral health services for individuals, providers and care coordination teams. Any unexpended or unencumbered balance remaining at the end of fiscal year 2027 shall revert to the behavioral health trust fund.

     SECTION 16. APPROPRIATION--LEGISLATIVE FINANCE COMMITTEE--BEHAVIORAL HEALTH AUDITS AND EVALUATION.--One million dollars ($1,000,000) is appropriated from the general fund to the legislative finance committee for expenditure in fiscal year 2026 and subsequent fiscal years to implement Section 9 of the Behavioral Health Reform and Investment Act. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.

     SECTION 17. APPROPRIATION--DEPARTMENT OF HEALTH--SUICIDE PREVENTION--YOUTH BEHAVIORAL HEALTH.--Nine million dollars ($9,000,000) is appropriated from the general fund to the department of health for expenditure in fiscal years 2026 through 2028 to expand suicide prevention and youth behavioral health supports in schools through educational resources, outreach, awareness, multi-component digital platforms and behavioral health services. Any unexpended or unencumbered balance remaining at the end of fiscal year 2028 shall revert to the behavioral health trust fund.

     SECTION 18. APPROPRIATION--PUBLIC EDUCATION DEPARTMENT--SUICIDE PREVENTION--YOUTH BEHAVIORAL HEALTH.--Six million dollars ($6,000,000) is appropriated from the general fund to the public education department for expenditure in fiscal years 2026 through 2028 to expand suicide prevention and youth behavioral health supports in schools through educational resources, outreach, awareness, multi-component digital platforms and behavioral health services. Any unexpended or unencumbered balance remaining at the end of fiscal year 2028 shall revert to the behavioral health trust fund.

     SECTION 19. APPROPRIATION--BOARD OF REGENTS OF THE UNIVERSITY OF NEW MEXICO--PROJECT ECHO.--One million eight hundred thousand dollars ($1,800,000) is appropriated from the general fund to the board of regents of the university of New Mexico for expenditure in fiscal years 2026 through 2028 to facilitate training through project ECHO for behavioral health care providers and behavioral health services to patients. Any unexpended or unencumbered balance remaining at the end of fiscal year 2028 shall revert to the behavioral health trust fund.

     SECTION 20. APPROPRIATION--HEALTH CARE AUTHORITY.--Two hundred thousand dollars ($200,000) is appropriated from the general fund to the health care authority for expenditure in fiscal year 2025 to initiate the planning, coordination and behavioral health standards in accordance with the Behavioral Health Reform and Investment Act. Any unexpended or unencumbered balance remaining at the end of fiscal year 2025 shall revert to the behavioral health trust fund.

     SECTION 21. APPROPRIATION--HEALTH CARE AUTHORITY-- CERTIFIED PEER SUPPORT.--Ten million dollars ($10,000,000) is appropriated from the government results and opportunity program fund to the health care authority for expenditure in fiscal year 2026 for regional certified peer support workers, justice liaisons, regional behavioral health services division staff and administrative staff and to implement Section 9 of the Behavioral Health Reform and Investment Act. Any unexpended or unencumbered balance remaining at the end of fiscal year 2026 shall revert to the government results and opportunity program fund.

     SECTION 22. APPROPRIATION--HEALTH CARE AUTHORITY-- CERTIFIED PEER SUPPORT.--Ten million dollars ($10,000,000) is appropriated from the government results and opportunity program fund to the health care authority for expenditure in fiscal year 2027 for regional certified peer support workers, justice liaisons, regional behavioral health services division staff and administrative staff and to implement Section 9 of the Behavioral Health Reform and Investment Act. Any unexpended or unencumbered balance remaining at the end of fiscal year 2027 shall revert to the government results and opportunity program fund.

     SECTION 23. APPROPRIATION--HEALTH CARE AUTHORITY-- CERTIFIED PEER SUPPORT.--Ten million dollars ($10,000,000) is appropriated from the government results and opportunity program fund to the health care authority for expenditure in fiscal year 2028 for regional certified peer support workers, justice liaisons, regional behavioral health services division staff and administrative staff and to implement Section 9 of the Behavioral Health Reform and Investment Act. Any unexpended or unencumbered balance remaining at the end of fiscal year 2028 shall revert to the government results and opportunity program fund.

     SECTION 24. CONTINGENT EFFECTIVE DATE.--

          A. The effective date of the provisions of Sections 1 through 10, 14 through 16 and 20 through 23 of this act is contingent upon Senate Bill 3 or similar legislation of the first session of the fifty-seventh legislature becoming law.

          B. The effective date of the provisions of Sections 1 through 15 and 17 through 20 of this act is contingent upon Senate Bill 1 or similar legislation of the first session of the fifty-seventh legislature becoming law.

     SECTION 25. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
